What regulates the minimum wage in Udmurtia

Basic normative act, which sets the minimum wage in Udmurtia, is the Federal Law of the Russian Federation "On the minimum wage" dated June 19, 2000 No. 82-FZ.

Regions have the right to independently establish regional values of the minimum wage, but at the same time it cannot be less than what is established at the federal level.

The decision on the size of the minimum wage in Udmurtia is made at a meeting of the tripartite commission by signing the Regional Agreement on the minimum wage in the Udmurt Republic. The agreement is signed by the Government of the Udmurt Republic, the Federation of Trade Unions of the Udmurt Republic, the association of employers of the Udmurt Republic, which are parties to this tripartite agreement.

Involvement in the work of the commission and the signing of the agreement by representatives of the authorities, employers and trade unions representing the workers of the Republic, allows the interests of all parties to the agreement to be observed to the maximum extent. By a joint decision, they determine the value of the minimum wage in Udmurtia. It will be valid until the next changes are made to Article 1 of the Federal Law of June 19, 2000 No. 82-FZ or the need to adjust the regional value of the minimum wage caused by changes in the situation on the labor market or in the economy is not ripe.

In accordance with the republican legislation, the updated value of the minimum wage in Udmurtia must be brought to the attention of all interested parties and is subject to publication in without fail. After information about the new minimum wage in Udmurtia is published in printed publications and on the official portal of the republican government, employers in the region must confirm their agreement with the new wage conditions in writing.

Employers have the right not to join the agreement signed by the tripartite commission. But in any case, the minimum wage in Udmurtia, which the employees of the Republic receive, cannot be less than what is established at the federal level. Violators of the law can be punished both administratively and under Article 145.1 of the Criminal Code of the Russian Federation.

The minimum wage is a federal or regional wage indicator, less than which the employer does not have the right to pay the employee. It is approved at the federal level and cannot be lower than a certain value, even if the regions have their own agreements governing the amount and procedure for calculating the minimum wage.

However, there is another such important factor, as a regional coefficient, which is set for different regions, and taking into account it, an increase in the indicator should be made. This norm also operates in the Udmurt Republic, so today we’ll talk about what the minimum wage is and what its value is, taking into account the Ural coefficient.

What is the MOT and why is it needed

The minimum wage, or simply the minimum wage, is the lowest wage that an employer has the right to set an employee. In addition to the salary itself, it is also necessary for calculating other components of a citizen's income, in particular temporary disability benefits due to illness or pregnancy and childbirth. Thanks to him, other payments guaranteed by the Social Insurance Fund are also calculated.

The minimum wage can be calculated both at the federal and regional levels. In the first case, the calculation procedure and the amount of payments are calculated using amendments to the Federal Law "On the Minimum Wage", which are regularly introduced by the government of the Russian Federation (usually once a year). This document determines the lowest level of wages, which the regions are guided by when developing their own documents. No subject of the Russian Federation has the right to set the minimum wage below the value approved by the latest amendments to the Federal Law.

At the same time, regions have the right to independently raise the minimum wage. This decision is made after discussion by the tripartite contact group, which includes:

  • representatives of the government of the region;
  • members of trade unions representing the interests of workers;
  • representatives of an organization representing the interests of employers (Union of Industrialists and Entrepreneurs).

After discussion and consultations on this issue, an appropriate document is being developed: an agreement on the minimum wage in a particular subject of the Russian Federation. As soon as the authorities of the region sign the document, it must be immediately published in the press. After that, a 30-day countdown begins, during which budgetary and non-budgetary organizations have the right to refuse to join the agreement. To do this, they must notify the administration of the region and indicate a serious reason why they cannot comply with the conditions prescribed in the document. If 30 days after the publication of the appeal to the authorities of the subject does not arrive, the employer joins it automatically and can no longer refuse to fulfill obligations.

So, as we said above, the size of the minimum wage can be approved both at the federal and at the regional level. However, you should pay attention to the fact that there are also regional coefficients and the so-called northern allowance. Their essence lies in the fact that residents of the regions of the Far North, as well as regions equated to it, receive wages and social payments indexed to the value of local coefficients. They range from 2 to 1.15, respectively, the increase in payments can range from 100% to 15%. The Ural regional coefficient is 1.15, which means that the indexation of payments should be made at the level of 15%.

However, the issue of applying this rule to the minimum wage is still very controversial. Various departments and organizations have different opinions on this:

  • The Supreme Court of the Russian Federation, in its rulings, considers that the regional coefficients and the northern allowance are not part of the minimum wage. Accordingly, the value must necessarily be increased by the specified value of the coefficient;
  • Ministry of Health and social development The Russian Federation does not recognize the definition Supreme Court a document that can regulate the relationship between an employer and an employee. Officials point to the norms of the Labor Code, according to which district coefficients should be included in the size of the minimum wage.

Be that as it may, today the value of the minimum wage is added to the regional coefficient, and residents of the republic can count on indexed wages. By how much does the minimum wage increase, and what is its significance in Udmurtia today? Let's talk about this further.
